Choosing a forex or CFD broker in the EU is not just about finding the lowest spread. EU retail investors have strong legal protections under MiFID II and ESMA rules โ but only if you choose a properly regulated broker. An unregulated broker can offer leverage with no limits, no negative balance protection, and no compensation if they go bust.
This checklist covers the 12 things you must verify before depositing a single euro.
The 12-point EU broker checklist
Go through this list before you open any live account. Mandatory items are marked with MANDATORY โ if a broker fails any mandatory check, do not deposit.

Licence verified on the regulator's official website MANDATORY
Find the broker's licence number on their website footer. Then go directly to the regulator's search portal (CySEC: cysec.gov.cy / FCA: register.fca.org.uk / BaFin: bafin.de / AMF: regafi.fr) and search for it. A licence number that doesn't appear in the official register is invalid โ full stop.

EU passport or equivalent national licence MANDATORY
An EU-passported licence (e.g., CySEC) allows the broker to operate across all EU member states legally. A non-EU licence (e.g., offshore FSC, SVG, Vanuatu) does not โ these brokers may operate illegally in your country and provide no EU legal protections.

ESMA leverage limits applied to retail accounts MANDATORY
Major FX pairs (EUR/USD etc.): maximum 30:1. Minor pairs / gold / major indices: 20:1. Commodities (excl. gold): 10:1. Individual equities: 5:1. Cryptocurrencies: 2:1. If a broker offers 500:1 to EU retail clients, they are not EU-compliant.

Negative balance protection confirmed MANDATORY
Required by ESMA for all retail EU accounts. This means you cannot lose more than your deposited balance, even in a market gap. Verify this is stated explicitly in the broker's retail account documentation โ not just in their marketing copy.

Client funds held in segregated accounts MANDATORY
Required by MiFID II. Your money must be kept in a separate bank account from the broker's operating funds. If the broker goes insolvent, your funds should not be part of the bankruptcy estate. Ask for confirmation in writing if unclear.

CFD risk warning displayed prominently MANDATORY
EU-regulated brokers must display the percentage of retail clients who lose money on their platform โ and it must be specific (e.g., "74% of retail CFD accounts lose money" โ not just a generic warning). If no percentage is shown, the broker is likely not EU-compliant.

Appropriateness test completed BEST PRACTICE
MiFID II requires regulated brokers to assess whether complex products (CFDs, forex) are appropriate for you based on your knowledge and experience. If a broker lets you open a live account with no questions asked, this is a yellow flag. Complete the assessment honestly โ it protects you.

Spread and commission costs verified BEST PRACTICE
A low headline spread can hide high commissions, or vice versa. Calculate the all-in cost per standard lot: All-in cost (pips) = Spread + (Commission per lot รท 10). For EURUSD: Exness Raw Spread = 0.0 + (7รท10) = 0.7 pips all-in. Pepperstone Razor = 0.07 + (7รท10) = 0.77 pips. Compare on this basis, not headline spread alone.

Withdrawal policy reviewed BEST PRACTICE
Check: minimum withdrawal amount, processing time (1โ3 business days = normal / more than 5 = yellow flag), and any withdrawal fees. Free withdrawals are now standard among reputable EU brokers. A broker that charges percentage-based withdrawal fees is unusual. Read the fee schedule, not just the marketing page.

Demo account available before depositing BEST PRACTICE
Any reputable EU broker offers a free demo account. Use it for at least one week before depositing real money. Test the execution speed, spread accuracy, and platform stability. A broker that refuses or makes it difficult to offer a demo is not one you want to use with real money.

No unsolicited bonus or deposit bonus MANDATORY
ESMA banned retail CFD bonuses across the EU in 2018. If a broker is offering you a deposit bonus (e.g., "50% bonus on your first deposit"), they are violating ESMA rules and are almost certainly not properly EU-regulated. This is a hard red flag โ do not deposit.

Check the ESMA / national regulator warning list MANDATORY
Both ESMA and individual national regulators publish public lists of brokers with warnings or bans. Search your broker name at esma.europa.eu/convergence/investor-protection and at your national regulator's warning list before depositing. Takes 2 minutes and can save you significant losses.
Red flags โ walk away immediately if you see these

Guaranteed profit or "risk-free" trading
All trading involves risk. Any claim of guaranteed returns is illegal under EU law (Directive 2005/29/EC) and a near-certain indicator of fraud.

No verifiable licence or offshore-only regulation
SVG, Vanuatu, and Seychelles licences provide no real consumer protection for EU traders. These jurisdictions have no meaningful regulatory oversight.

Pressure to deposit more or urgency tactics
Phrases like "this offer expires in 24 hours" or "your account manager is waiting" are social engineering. Legitimate brokers do not pressure you to deposit.

Leverage above 30:1 offered to EU retail clients
This violates ESMA rules outright. Any broker offering 500:1, 200:1, or even 50:1 to EU retail accounts is not compliant and likely unlicensed in the EU.

Difficult or refused withdrawals
If your withdrawal takes more than 5 business days with no explanation, or if the broker adds sudden fees or asks for excessive "verification" when you try to withdraw, stop and contact your national regulator.
